The terms & conditions contained herein along with the Privacy Policy form an Agreement regulating our relationship with regard to the use of Sundari Silks by you. DEFINITIONS

"Agreement" means the Terms & Conditions as detailed herein including all schedules appendices, annexures and privacy policy, and will include the references to Agreement as amended, novated, supplemented, varied or replaced from time to time.

"Sundari Silks "/ "Site" means the online shopping platform owned and operated by Sundari Silks, Chennai, India, which provides a venue to the users of SundariSilks.com to buy the products listed on Sundari Silks.

"Vendor"/"Seller" shall mean the person or any legal entity who offers for sale, sells the products on Sundari Silks.

"Customer" / "Buyer" shall mean the person or any legal entity who accepts the offer for sale on Sundari Silks by placing an order and/or purchases any products offered for sale on Sundari Silks .

"User"/ "You" means and includes you and/or any person or an entity including Vendor/Seller using or accessing the services provided on this Site.

ELIGIBILITY

You represent and warrant that you are competent and eligible to enter into a legally binding agreement and have the requisite authority to bind the other party to this Agreement. You shall not use this Site if you are not competent to contract under the applicable laws, rules and regulations.

TERM OF AGREEMENT/SERVICE

This Agreement shall continue to be in full force and effect for so long as you are using the Sundari Silks services.

SundariSilks.com provides the online shopping platform wherein the users can purchase/buy the products listed on Sundari Silks (the "Services") pursuant to the Terms & Conditions set forth below.

By purchasing the products from SundariSilks.com, you are agreeing to use the services in a manner consistent with and abide by the Terms & Conditions of this agreement, our privacy policy, and with all applicable laws and regulations.

Either you or SundariSilks.com may terminate the service at any time, with or without cause. However, SundariSilks.com reserves the right, in its sole discretion, to terminate your access to the Sundari Silks services and the related services or any portion thereof at any time, without notice. The provisions of Sections 13,14,15,16 and 18 shall survive any such termination.

Modification of
Terms & Conditions of Service

SundariSilks.com may at any time modify the Terms & Conditions ("Terms") of the Service without any prior notification to you. You can access the latest version of the terms at any given time. You should regularly review the terms. In the event the modified terms are not acceptable to you, you should discontinue using the service. To avail of and use the Services you will have to register with Sundari Silks. If you provide any information that is untrue, inaccurate not current or incomplete or SundariSilks.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, SundariSilks.com has the right to indefinitely suspend or terminate your membership and refuse to provide you with access to Sundari Silks.

You agree, understand and acknowledge that Sundari Silks is an online shopping platform, a venue enabling the users to buy any product listed on Sundari Silks at the price indicated on the Terms & Conditions indicated therein at any time from any place.

You further agree and undertake that you are accessing the services available on this Site and transacting at your sole risk and are using your best and prudent judgement before entering into any transaction through this Site. Sundari Silks accepts no liability for any errors or omissions, whether on behalf of itself or third parties. All orders shall be pre-approved with an acceptable method of payment as established by Sundari Silks which may call for and require additional verification or information. The address at which delivery of the product ordered by you is to be made should be correct and proper in all respects. Any and all orders placed by you on this Site are a firm commitment to purchase and you are obligated to complete the transaction and not contest it in any way. Before placing an order you are advised to check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale included in the item's description. Prices mentioned here are all Net Prices after applying respective tax, freight and discounts. Photo ID proof of Credit Card holder is required at time of delivery Sundari Silks takes care to ship the orders in good condition, properly polythene packed and then wrapped in packing paper. Sundari Silks is not to be responsible for wrong delivery due to incorrect or incomplete address details provided by the customer. Sundari Silks is committed to safeguarding customers' personal information. Any information required for process and execution of orders will not be shared or passed on for any other purpose.

Credit card details

You agree, understand and confirm that the credit card details provided by you for availing of services on Sundari Silks will be correct and accurate and you shall not use the credit card which is not lawfully owned by you. You further agree and undertake to provide the correct and valid credit card details to Sundari Silks. Further, the said information will not be utilised and shared by Sundari Silks with any of the third parties unless required by law, regulation or court order.

Confirmation

You understand, declare and agree that:

Suspension due to
non-compliance with Agreement

Notwithstanding other legal remedies that may be available to Sundari Silks , Sundari Silks may in its sole discretion limit the User activity by immediately removing the User listing either temporarily or indefinitely or suspend or terminate the User membership, and/or refuse to provide the User with access to the Site.

If the User is in breach any of the terms & conditions of this Agreement and/or the terms & conditions of usage of Sundari Silks;

If the User has provided wrong, inaccurate, incomplete or incorrect information;

If the User actions may cause any harm, damage or loss to the other Users or Sundari Silks.

Illegal and/or unauthorised use of the Service, including unauthorised framing of or linking to the SundariSilks.com will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal and injunctive redress. This clause shall survive the expiry or termination of this Agreement.

Limitation of Liability

In any case, the liability of Sundari Silks.com is not more than actual product value.

Sundari Silks will not intentionally monitor or disclose any private messages or address information unless required by law, regulation or court order. TERMS & CONDITIONS FOR ONLINE SAVE & BUY

• Registration for the Save & Buy scheme can be made only at Sundari Silks showrooms. Monthly payments can be done through the digital dashboard on the Sundari Silks website, only from the second instalment onwards.
• Members can register under 4 different plans, where they can pay a monthly subscription of INR 500/1000/2000/5000 for a period of 11 months without fail. The instalment for the 12th month will be borne by Sundari Silks.
• Members can avail either of the following benefits:
  • A. Choose a scheme product from the Sundari Silks vessels collection for a value that equals the 12th month's incentive. This scheme product can be claimed anytime during the duration of the scheme.
    (OR)
    B. The 12th-month incentive offered by Sundari Silks can be added to the scheme value and the member can purchase products of their liking from the Sundari Silks showroom.
• This scheme is exclusive and cannot be linked to any existing or future schemes. The scheme amount cannot be utilised for the purchase of jewellery, gold coins or café products.
• Payment modes offered include cash, cards, cheques, M.O, demand drafts (in the name of Sundari Silks India), as well as door-to-door collection.
• In case of a dishonour of cheque issued towards the payment of monthly instalment, the member will be required to bear the charges of Rs.130/-
• When a member fails to make payments for 3 months consecutively, the scheme will be deemed discontinued.
• If a member wishes to discontinue the scheme, they may do so only after completing 3 months in the scheme.
• In the case of discontinuance, the payment made thus far cannot be refunded as cash. The member will receive a credit note for the said value, which they may use to make a purchase at the Chennai and Mumbai showrooms only. Such purchases cannot be made at the online store.
• In case of discontinuance, members will not be eligible for any of the scheme benefits. If the scheme product has been claimed before discontinuance, the value of the same shall be deducted from the total purchase redeemable value.
• Please note that we do not refund money for exchanges and returns. The member will be given a one-time credit note which can be utilised for future purchases.
• Amount paid towards the scheme will not be refunded under any circumstances.
• The Advance amount paid will not be eligible for any interest.
• It is the member's responsibility to inform Sundari Silks if this card gets lost or damaged. In such circumstances, Sundari Silks shall provide a replacement card and the member will be charged a fee of Rs.50/-. Members are expected to provide a letter with appropriate ID proof and a matching signature to avoid misuse of the card.
• Sundari Silks India reserves the right to alter, amend, modify and/or delete any of the terms & conditions mentioned, from time to time. The right to enrolment will be at the discretion of the Sundari Silks management. The conduct of the scheme is subject to the terms & conditions laid down by the Central/State Governments. All disputes are subject to the jurisdiction of the competent court in Chennai.
